His story has many similarities to ours. This is great advice and I will be talking to our accounting firm (DKTax)to see if we should do the same.

Yes, in fact, that's what we'll be doing. But it costs him extra (hopefully his old tax preparer will refund the prep fees he paid the first time) and does mean extra hassle.

Still, getting it back is better than losing it!

Hi Richard,
To quote my partner, Diane Kennedy, "it depends." The thing that may play in your favor is you have your LLC set up; however, other factors will come into play. Have you been operating AS a business, have you funded the business, what have you been doing to find investment properties, etc. We've heard from some people that IRS has reclassified some seminars and courses as non-deductible personal enrichment programs. You may want to contact Richard at CPA@dktaxservices.com to find out about our programs and how we can possibly help you with your business.

Hi Russell,
An LLC would very likely be beneficial for you in both cases: your owner-occupied 4-plex, and your second 4-plex. How to set up the LLC (or maybe more than one LLC), and perhaps even do it through a Trust Sandwich for a better overall result, would depend on several factors including how much equity you have in the property, other aspects of your tax situation, and your exposure to risk.

I'd like to suggest getting in touch with Richard at CPA@dktaxservices.com to learn about the programs we have available, and how we'd be able to make sure you're heading in the right direction.

Hello,
I will be buying a 4 plex in two months and will be owner occupeid---is there an LLC that is right for me? In the future i will buy a second 4 plex about a year from the frist one . Will the LLC for the frist one cover the second one? What would you do to protect yourself and get the most tax relief?

Thank You
